These rules are in Article 9 of Federal Decree-Law No. 33 of 2021. Probation cannot exceed 6 months. Leaving without following them can lead to a one-year ban on a new work permit, though some workers are exempt.

Worked example

You join on 1 July 2026 with 6 months' probation, so probation ends on 31 December 2026. If on 1 October you resign to join another UAE employer, your earliest last day is 1 November 2026, one month later. If instead your employer ends the contract on 1 October, your earliest last day is 15 October.

How long can probation be in the UAE?

No more than 6 months from your first day of work. It cannot be extended beyond 6 months.

How much notice must my employer give during probation?

At least 14 days' written notice before the contract ends.

How much notice must I give to move to another UAE employer during probation?

At least one month's written notice. Unless agreed otherwise, the new employer compensates your first employer for recruitment costs.

What if I resign during probation to leave the UAE?

Give at least 14 days' written notice. If you return and join a new UAE employer within 3 months, the new employer pays the first employer's recruitment costs, unless agreed otherwise.

Does probation count towards my service?

Yes. If you stay on after probation, the probation period counts towards your service for gratuity and leave.

Do I get paid sick leave during probation?

No. Paid sick leave starts after probation. Unpaid sick leave may be approved by your employer with a medical report.
